THANK YOU FOR YOUR PURCHASE FROM BABYCAKES HAMPERS. WE VALUE YOUR ORDER AND APPRECIATE YOUR SUPPORT FOR YOUR LOCAL BUSINESS.

To the fullest extent legally permissible, all dealings between Babycakes Hampers and you our customer relating to the purchase of any goods and/or services are subject to the following Terms and Conditions unless otherwise agreed in writing.

PAYMENT

You will receive an order confirmation email once you have placed an order and full payment for the goods including delivery charges has been made and without deductions unless otherwise agreed. Payments to be made via the approved safe methods provided on this site. Cheques, bank transfers or cash will not be accepted.

Cancelled orders once the assembly of the order has commenced will incur a 20% cancellation fee

PORTRAYAL OF PRODUCTS

While every effort has been made to portray items accurately, slight variations may occur. All measurements are as shown. Materials and finishes are as accurate as photographic and publishing processes will allow. Please note that there may be variations in colours and products based on availability.

COPYRIGHT

All rights, including copyright, for the website are owned by or licensed to Babycakes Hampers. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of Babycakes Hampers.

AVAILABILITY

All items are subject to availability. Any discontinued or out of stock item will be replaced with a product of equal or higher value. Delivery times vary depending on the product stock and availability, however utmost effort will be made to ensure the arrival of your order within the specified times.

DELIVERY OF GOODS

Adequate access and entry to the delivery address specified on your order must be ensured to allow for the delivery of your order. If a delivery cannot be made, a card will be left and you will be responsible for the collection of the product from our designated location. Should you opt for a second delivery attempt by us, an  additional fee will apply and which you will be liable for. If the goods need to be re-delivered due to an error on your behalf, or incorrect information given by you, additional charges will apply. You may be liable for storage fees should the returned item not get picked up within 3 business days.

Customer pick-ups are only permissible in special circumstances and when agreed upon by Babycakes Hampers.

We do not accept responsibility with respect to delivery failures or delays by our third party delivery contractor or Australia Post once the product is dispatched from our warehouse.

FAULTY/DAMAGED GOODS

It is the responsibility of the customer/recipient to immediately inspect the goods upon delivery.  Please report any damages immediately. Babycakes Hampers will not take any responsibility for damaged products reported after 24 hours of the receipt of the order. If damage has occurred due to shipping please keep all packaging and provide photographic evidence with your complaint. Failure to do so may invalidate any claim. Babycakes Hampers will not be liable for any loss or expense arising after goods have been unpacked, used or applied after which there shall be deemed unqualified acceptance. Your claim will be processed within 3 to 7 business days and any faulty product will be replaced free of charge.

RETURNS AND EXCHANGES

If you are unhappy with a product for a valid reason, send us an email within 24 hours of receiving it and ship product back within 3 business days, in the original packaging and in perfect condition, and we will arrange a Credit Note or Exchange minus 30% restocking fee. Postage, packaging and insurance incurred in the returns process cannot be refunded. You will be responsible for the cost of returning the goods to us by certified mail, and will remain responsible for any and all returned goods until received and signed for.

Returns and exchanges will be handled with as soon as possible after arrival, and a Credit Note will be sent to you to be applied to future orders, with a 3 months validation period. Our returns email address is: gisele@BabycakesHampers.com.au

Please note, each case will be assessed individually and a decision will be based on circumstance and reason for return. Change of mind will not be accepted

PRICE INCREASES

We make no warranty or guarantee that our prices are the cheapest recommended retail price and we reserve the right to increase our pricing due to cost increases of goods and materials without notice.

LIABILITY DISCLAIMER

Babycakes Hampers’ total liability for any claim shall not exceed the price of the goods supplied to the customer. Babycakes Hampers shall not be liable for any consequential loss whether this arises from a breach of duty in contract or in any other way, save where such liability is imposed upon Babycakes Hampers by statute. Babycakes Hampers cannot accept any liability for a customer’s failure to comply with instructions specifically stated in the instructions. Babycakes Hampers shall not be responsible for any failure to comply with any requirements of you relating to the design or assembly of any product which was not precisely and accurately communicated in writing directly to Babycakes hampers prior to the entry into any relevant sale contract. We shall not be deemed in fault or breach of any contract as a result of Force Majeur including any cause beyond our reasonable control. No warranty shall be given where we are not the manufacturer of the product. Our liability is strictly limited to the assembly of the products only. Please note, nappies used in our Nappycakes are folder or wrapped and may become creased. It is recommended that you unfold and flatten back to original shape prior to use to prevent leakage.

YOUR RIGHTS UNDER THE AUSTRALIAN CONSUMER LAW

Consumer guarantees cannot be excluded or any warranty given to you, however, there may be circumstances where you are not entitled to a remedy where you have:

  1. You have received what you ordered but have simply changed your mind, found a cheaper alternative elsewhere, did not like the item or found no use for the item
  2. Used the item or misused it causing a problem
  3. Found a fault after the 3 day grace period

In order to submit a claim for a defective product, you will need to, at your own cost, contact our head office and send notice via email at: gisele@BabycakesHampers.com.au with details of your name, address, telephone number, details of the goods purchased and details of the defect claimed. You must cease using the product immediately and must notify us withing 24 hours of receipt of the delivery.
